Council approval in terms of the restrictive conditions C.2, C.3 & C.4 (T000020001/2021) applicable to Erf 1472 Hout Bay which read: “Not more than one dwelling house together with such outbuildings as are ordinarily required to be used in connection therewith shall be erected on the land except with the approval of the controlling authority as defined in Act 21 of 1940”; “The land shall be used for residential and agricultural purposes only, and no store or place of business or industry whatsoever, may be opened or conducted on the land without the written approval of the Controlling authority as defined in Act 21 of 1940”; and “No building or any structure whatsoever shall be erected within a distance of 96,46 metres from the centre line of the road, without the written approval of the controlling authority as defined in Act 21 of 1940” respectively. </li><li>
Departures from the <a href="http://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/the-city-of-cape-towns-development-management-scheme">Development Management Scheme</a>:<br>Item 49(e): To permit Blocks A & C setback 4,33 m, 2,99 m and 3,79 m in lieu of 5 m from the northern common boundary permitted, and Block B, and store setback 3 m and 2,5 m respectively in lieu of 5m from the southern common boundary permitted.<br>Item 121(2): Retaining wall 0,5 m in lieu of 5 m setback from a designated metropolitan road.<br>Item 136B(a): To permit a boundary wall along Hout Bay Main Road to be 3,225 m high in lieu of a maximum of 2.0 m in height permitted.<br>Item 136(g)(bb): To permit a boundary wall along Hout Bay Main Road with 0 permeability in lieu of 25%.<br>Item 140(2)(c): To permit a carriageway crossing 8,5 m wide in lieu of 8 m wide. </li><li>
