Comment on the proposed amendments to the City’s Municipal Planning By-law

We would like to invite interested and affected residents to comment on the proposed amendments to the City of Cape Town Municipal Planning By-law, 2015 (MPBL).

The City is aware of the recent website downtime. While the advertised closing date for comments on the MPBL amendments remains unchanged, comment submissions will continue to be accepted until close of business on Wednesday, 22 July 2026, to ensure that all interested and affected parties have a reasonable opportunity to comment.

The MPBL, which is inclusive of the City of Cape Town Development Management Scheme (DMS) as schedule 3, came into effect on 1 July 2015. Since then, it has been amended a few times.

Further amendments are now proposed, which broadly seek to:

  • make the grant of building plan approvals transparent, by requiring public notice of every building plan approval and by giving surrounding neighbours access to the approved building plan and the reasons for it;
  • rework Chapter 8A of the By-law, which deals with the rectification of approvals and building plan approvals, into a consent-based process supported by a new third-party complaint mechanism; and
  • correct errors in, and clarify, certain provisions of the MPBL and the DMS, including the provisions that preserve approvals granted under the previous planning laws.

Notice is hereby given in terms of section 17 of the Local Government Municipal Systems Act, that interested and affected residents may submit comments in respect of the proposed amendments.
