Comment on the proposed change to the method of delivery of notifications for certain applications in terms of the City’s Municipal Planning By-Law (MPBL)<span> <h2 class="sectHeading">​​​​​​​​​​About</h2></span> <p> If we receive an application that, if approved, may affect the rights or legitimate expectations of a person adversely, we are required to notify that person of the application. Currently, we deliver most of these notifications by registered mail and we want to change this method formally to electronic mail. </p><p>We therefore propose that the City Manager prescribe the below in terms of sections 110, 111(3) and 138 of the MPBL:</p><ul><li>A person to whom notification in terms of the MPBL may or must be given must provide the City with an email address in the manner called for by the City. </li><li>The person providing the email address must inform the City of any change to their email address. </li><li>A failure to provide or update an email address is regarded as a waiver of any right to receive a notification. </li><li>If a person provides an email address or if the City has an email address for the person, the City may send a notification contemplated in the MPBL only by email regardless of whether the person requests a different or additional method of notification. </li><li>In accordance with section 111(3) of the MPBL, if the City sends a notification by email, the City is not required also to serve the notification in a manner provided by sections 111(1)(b)(i)-(1)(b)(v) of the MPBL. </li><li>Such prescription will apply with immediate effect to future notifications, including to a notification concerning an application made before such prescription.</li></ul><p>Notice is given in accordance with section 17 of the Local Government: Municipal Systems Act, Act 32 of 2000, that you can submit comments in respect of the proposed changes. </p><p>Access the advert (<a href="" target="_blank">English</a> |<a href="" target="_blank"> Afrikaans </a>| <a href="" target="_blank">isiXhosa</a>).</p> <span> <h2 class="sectHeading">​​​​​​​​​​Comment period</h2></span> <p>Submit your comments and/or objections from <strong>22 January - 22 February 2024</strong>.</p> <span> <h2 class="sectHeading">​​​​​​​​​​Submit your comment</h2></span> <p>Comments may be submitted via the following channels: </p><p> <strong>Online</strong> <br><a href="" target="_blank">Submit your comments online</a>. </p> <span> <div class="notification with-heading dark-copy pink bg-light-grey"><div class="graphic with-border"> <i class="info note">​​​</i> </div><div class="desc"><h4>Please note</h4><p> Our Public Participation Unit will assist you if you would like to submit comments but have a disability or are unable to read or write.
