Comment on the City’s draft By-law relating to the Repeal of By-Laws adopted by Former Municipalities
About the by-law

We are required, in terms of section 15 of the Local Government: Municipal Systems Act, 2000, to keep an updated copy of our Municipal Code. To do this, we need to remove outdated legislation that is no longer applicable.

There are already two City By-laws relating to the Repeal of By-laws adopted by Former Municipalities, namely:

By-law Relating to the Repeal of By-laws Adopted by Former Municipalities, 2007

By-law Relating to the Repeal of By-laws Adopted by Former Municipalities, 2016

This will be the third and last by-law of its kind.

Recent research has shown that there are still numerous by-laws that were promulgated by former municipalities which have been incorporated into the City, and are still regarded as being in force today.

Most of these by-laws have been replaced with modern or updated by-laws or by national or provincial laws but have not yet been repealed by the City. Consequently, these by-laws still technically form part of the Municipal Code of the City and need to be repealed.

In terms of section 17 of the Local Government: Municipal Systems Act, Act 32 of 2000, you can submit comments to the municipality in respect of the draft by-law.

Access the documents:

Draft Repeal By-law, 2023

Schedule to the By-Law relating to the Repeal of By-Laws adopted by Former Municipalities.

Bellville Municipality

Brackenfell Municipality

City of Cape Town

Durbanville Municipality

Fish Hoek Municipality

Goodwood Municipality

Gordon's Bay Municipality

Helderberg Municipality

Kraaifontein Municipality

Kuils River Municipality

Milnerton Municipality

Parow Municipality

Pinelands Municipality

Simon's Town Municipality

Somerset West Municipality

Strand Municipality

Comment period

Please note

The comment period closed on 30 November 2023.
