Comment on the City’s intention to consider the appointment of an external service provider for the provision of municipal services in the V&A Waterfront<span> <h2 class="sectHeading">About​​​​​​​</h2></span> <p> Section 76 of the Local Government: Municipal Systems Act 32 of 2000 (“the Act”) stipulates that municipalities may choose to provide municipal services through internal or external mechanisms, including an external service provider. <br></p><p> V&A Waterfront Holdings Proprietary Limited ("V&A WH") has historically provided, and currently continues to provide various municipal services within the V&A Waterfront area ("V&A Waterfront"). The provision of such municipal services commenced prior to the Act coming into effect (the Act came into effect on 1 July 2004).<br></p><p> A municipality may from time to time, and must in certain specified circumstances set out in the Act, review and decide on the appropriate mechanism to provide municipal services in the municipality or a part of the municipality. The City Council previously resolved to embark on a process to review and determine the appropriate mechanism for the continued and future provision of municipal services in the V&A Waterfront.</p><p>The City Council has since, in accordance with section 77 as read with section 78 of the Act, undertaken an investigation and assessment to review the existing mechanism for the provision of municipal services in the V&A Waterfront, being the provision of such services by an external service provider. <br></p><p> Furthermore, Section 78 (3) (b) stipulates that municipalities must take into account the following while conducting the assessment:</p><ul><li> <strong>Section 78(3) (b) (i):</strong> The direct and indirect costs and benefits associated with using the external service provider, including the expected effect on the environment and on human health, well-being and safety </li><li> <strong>Section 78(3) (b) (ii):</strong> The capacity and potential future capacity of prospective service providers to furnish the skills, expertise and resources necessary for the provision of the service<br></li><li> <strong>Section 78(3) (b) (iii):</strong> The views of the local community </li><li> <strong>Section 78(3) (b) (iv): </strong>The likely impact on development, job creation and employment patterns in the municipality </li><li> <strong>Section 78(3) (b) (v):</strong> The views of organised labour </li></ul><p>Notice, in terms of Section 78(3) of the Act, is hereby given that we intend to assess the continued provision of municipal services in the V&A Waterfront through an external service provider going forward. </p><p> In terms of section 17 of the Local Government: Municipal Systems Act, Act 32 of 2000, you can submit comments to the municipality in respect of the proposal. </p><p> We will consider all comments before making a final decision. </p><p> Access the <a href="https://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/VA_Waterfront_External_Mechanisms_Info_Statement.pdf" target="_blank">information statement</a> for more information. </p><h2 class="sectHeading">Comment period</h2><p>Submit your comments from <strong>4 June – 25 June 2024</strong>.</p><h2 class="sectHeading">Submit your comment</h2><p> <strong>Online</strong><br><a href="https://www.capetown.gov.za/_layouts/15/WebFeedback.SharePoint/webfeedback.aspx?id=96994e6c-0137-49fc-8ef7-448f6db9eb94" target="_blank">Submit your comment online</a>.</p><p> <strong>Delivery</strong><br> Deliver your written comments by hand to your nearest <a href="https://www.capetown.gov.za/Family%20and%20home/Meet-the-City/city-council/find-your-councillor-ward-or-subcouncil" target="_blank">Subcouncil office</a>.</p> <span> <div class="notification with-heading dark-copy pink bg-light-grey"><div class="graphic with-border"> <i class="info note">​​​</i> </div><div class="desc"><h4>Please note</h4><p>Our Public Participation Unit will assist you if you would like to submit comments but have a disability or are unable to read or write.
