<p>Notice is hereby given, in terms of the
<a href="http://resource.capetown.gov.za/documentcentre/Documents/Bylaws%20and%20policies/Management%20of%20Certain%20of%20the%20City%20of%20Cape%20Towns%20Immovable%20Property%20Policy%20-%20approved%20on%2026%20August%202010.pdf" target="_blank">Management of certain of the City of Cape Town’s Immovable Property Policy </a>(adopted by Council on 26 August 2010 C54/08/10) and Chapter 4 of the Municipal Asset Transfer Regulations (2008), that we are considering the management agreement of the following City-owned property:</p>

<p>The Community, Arts and Culture Development Department plan to grant
<strong>Durbanville Cultural Society (NPO 003-410)</strong> rights to use, manage, control and further redevelop the arts and culture service offering of the above-mentioned property for a period of nine years and 11 months. </p><p> The City recognises the benefits and importance of involving local communities and regular users in the management, maintenance and security of community assets. By entering into cooperative management agreements, we are promoting a sense of ownership, pride and communal responsibility. The agreement provides clear guidance on the rights, roles and responsibilities of users operating on communal facilities.</p><h4>Information Statement</h4><ul><li>
<strong>Reason:</strong> The agreement will ensure the continued use of the site as a vibrant arts and cultural hub, enabling the NPO to plan and invest in long-term programming. It also allows for partnerships with external organisations, enhancing innovation and access to new networks. Operational responsibilities will shift to the operator, allowing the City to focus on strategic oversight and broader cultural development. </li><li>
<strong>Expected benefit: </strong> The granting of rights will ensure the ongoing use of the facility as an arts and cultural hub, preserving its heritage value and legacy as a public arts space without direct City operation. It will also reduce the City’s financial and administrative burden for minor maintenance and operations while ensuring that the facility remains productive and well-cared for. </li><li>
<strong>Expected proceeds: </strong>The NPO will pay a nominal rental equal to the tariff rental for social facilities of R1205.22 per annum (Excl. VAT.) subject to increase in accordance with the City’s tariff structure as approved by Council and as may be amended from time to time. </li><li>
<strong>Expected gain or loss:</strong> no loss will be incurred by the City arising from the agreement. </li><li>The proposed transaction includes a call for alternative proposals.</li></ul><h4>Alternative proposals must include: </h4><ul><li>A proven track record of successfully managing similar facilities. </li><li>A business plan proposal for the Rust-en-Vrede Cultural Centre, which must include a detailed annual programme, products and services offered, operational strategy, an integrated sustainability plan (this must include the business model and operating budget). The proposal must also explain how the principles of diversity, equity and inclusion are embedded in the plan. </li><li>The organisation’s registration certificate </li><li>The organisation’s constitution </li><li>Management structure of the organisation </li><li>Certified copies of IDs of committee members and responsible officials </li><li>Latest audited financial statement </li><li>A valid tax compliance status certificate </li><li>Municipal account paid up to date </li></ul><p>In terms of section 17 of the Local Government: Municipal Systems Act, Act 32 of 2000, the public and interested parties or groups are given the opportunity to submit comments, inputs or alternative proposals to the municipality in respect of the proposed management area.</p><p><a href="https://resource.capetown.gov.za/documentcentre/Documents/City%20strategies%2c%20plans%20and%20frameworks/Rust-en-Vrede_Cultural_Centre_Lease_Plan.pdf" target="_blank">Access the locality map</a>.</p>
