Comment on the proposed lease of a portion of Upper Towers Road in MuizenbergComment on the proposed lease of a portion of Upper Towers Road in Muizenberg<img alt="" src="https://resource.capetown.gov.za/cityassets/PublishingImages/CityConnectHeader.png" style="BORDER:0px solid;" /><div class="ExternalClassD302E73B3BF04209A6762C5A56870319"><p>We are considering the lease of City-owned property in Muizenberg, and we want to hear from you.</p></div><span> <h2 class="sectHeading">​​​​​​​​​​About​​​​​​​</h2></span> <p>In accordance with section 16.5 and 16.6 of the <a href="http://resource.capetown.gov.za/documentcentre/Documents/Bylaws%20and%20policies/Management%20of%20Certain%20of%20the%20City%20of%20Cape%20Towns%20Immovable%20Property%20Policy%20-%20approved%20on%2026%20August%202010.pdf" target="_blank">Management of certain of the City of Cape Town’s Immovable Property Policy </a>(adopted by Council on 26 August 2010 C54/08/10) and Chapter 4 of the Municipal Asset Transfer Regulations (2008) we are considering the lease of the following City-owned property:</p> <span> <table style="width:535px;"><thead><tr><th>Erf/Farm number</th><th style="width:161px;">Extent (±Ha)​</th><th colspan="1">Street and suburb</th><th colspan="1">​Current zoning</th></tr></thead><tbody><tr><td>Portion of Public Street being Portion of Remainder Erf 88266 Cape Town</td><td style="width:161px;">± 18 m²</td><td colspan="1">Upper Towers Road, Muizenberg</td><td colspan="1">​Transport 2</td></tr></tbody></table>​​​</span> <p>We plan to renew the lease of the property to <strong>Estate Late Brian Pemberton</strong> or his successors-in-title (Maria Antoinette Pemberton being the sole heir to Erf 144102, Muizenberg) for garage purposes. </p><h4>Information statement</h4><ul><li> <strong>Reason: </strong>the property is not required for the provision of a minimum level of basic municipal service; </li><li><strong>Expected benefit:</strong> the property is underutilised, surplus to Council’s requirements, no demand exist for same, and the lease will furthermore relief Council of a maintenance burden and generate funds for the City of Cape Town; </li><li><strong>Expected proceeds:</strong> that the City will receive a market related rental of R850.00 per month, excluding VAT and including Rates for a period of ten years, the rental to be reviewed after five years, subject at any time to two month’s notice of termination. The rental is effective and payable as from 2025-02-01, escalating at 6% per annum for the proposed lease for garage purposes.
