Comment on the proposed amendments to the lease agreement for Herzlia Sports Ground in VredehoekComment on the proposed amendments to the lease agreement for Herzlia Sports Ground in Vredehoek<img alt="" src="https://resource.capetown.gov.za/cityassets/PublishingImages/CityConnectHeader.png" style="BORDER:0px solid;" /><div class="ExternalClass3802A7FF571B4BCEB8D9C4353CCC4B35"><p>Notice is hereby given that the City has received a request from the lessee of the Herzlia Sports Ground to amend certain conditions contained in the existing lease agreement, and we want to hear from you.</p></div><span> <h2 class="sectHeading">​​​About​​​​​​​</h2></span> <p> Notice is hereby given that the City is considering amending certain conditions contained in the existing lease agreement for the following city-owned property:​​</p> <span> <div class="mobile-scroll"><table style="width:510px;"><thead><tr><th>Erf/farm number</th><th style="width:122px;">Extent (±)<br></th><th>Street and suburb</th><th colspan="1">Current zoning<br></th></tr></thead><tbody><tr><td>Erf 2664, Vredehoek</td><td style="width:122px;">± 470 m²</td><td>12 Capel Road, Table Mountain<br></td><td colspan="1">​Open Space Zone 2<br></td></tr></tbody></table></div>​​​</span> <p>The lessee has raised concerns relating to the ongoing operational, financial and liability arising from specific clauses in the lease agreement. The proposed amendment aims to: </p><ul><li>ensure the sustainable management of the facility; </li><li> protect its primary function as a sports ground; and </li><li> align responsibilities more equitably between the lessee and the City.</li></ul><h4>Purpose of the proposed amendments</h4><p>The purpose of the proposed amendment is to omit certain clauses from the lease agreement that currently require unrestricted public access and mandated third-party use of the sports fields. These conditions have resulted in:</p><ul><li>Safety risks to children, staff, and grounds personnel </li><li>Damage to playing surfaces and increased maintenance costs </li><li>Operational and financial strain on the lessee </li><li>Limited ability to responsibly manage and protect the facility</li></ul><p>There is an alternative public open space available immediately adjacent to Van Riebeeck Park, which can continue to accommodate informal recreation and dog walking activities.</p><h4>Clauses requested for omission</h4><p>The lessee has formally requested the omission of the following clauses from Schedule 1 – Contract Details of the lease agreement:</p><ul><li> <strong>Clause vii: </strong> <br> <em>“Full public access when the field is not used for sporting purposes by Lessee</em>.” </li><li> <strong>Clause x: </strong> <br> <em>“Grass Roots FC to use the fields during their season on Saturdays from 1 March until 30 September within a calendar year, including pre-season and Cape Town Tygerberg Football Season dates.”</em> </li><li> <strong>Clause xi: </strong> <br> <em>“Grass Roots FC to use the field twice in the evenings from 17:15 to 18:30 and the use of Club House and toilet when they use fields.”</em></li></ul><h4>Motivation and background</h4><p>Unrestricted public access has led to uncontrolled dog activity on the sports fields, including digging and fouling of playing surfaces, despite leash signage. These conditions have resulted in damage to the fields, safety incidents involving grounds staff and children and increased maintenance requirements. </p><p>The mandated use of the fields by Grass Roots FC has resulted in overuse of the field between the club and school, with limited recovery for the pitch.
