You (along with any objectors) will be informed of the rights of appeal available to anyone who is unhappy with the decision. If you would like to appeal, you can follow the process outlined below.</p></div> | <span>
<h2 class="sectHeading">How to lodge your appeal</h2>
<p>Complete the
<a href="https://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/MPBL-LUM17_Appeal_form.pdf" target="_blank">Land Use Application Appeal Form</a> to appeal a decision in terms of the <a href="https://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/planning-by-law">City of Cape Town Municipal Planning By-law, 2015</a> and submit to the relevant <a href="https://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/CCT_DM-LUN_Appeals_mailboxes.pdf" target="_blank">district appeals email address</a>. </p>
<p>We must receive the appeal within 21 days following the date of notification. </p>
<p>Once an appeal is lodged, the City’s original decision is suspended. This means that the applicant cannot implement the decision until the appeal has been processed and the outcome announced. </p>
<p>If the appeal is received within the prescribed time period and is therefore valid, it is circulated to the relevant parties for a response. Once these responses have been received and the reasons for the appeal have been considered, a report is prepared and sent to the Office of the Executive Mayor. </p>
<p>The Executive Mayor, being the appeal authority, will make a final decision and all parties will be informed in writing. Written notice of the decision, including reasons to the parties of the appeal, will be delivered within 30 days of the decision.</p>
