Purpose of the application

  • Deletion of restrictive conditions C.2.(b), C.2.(c) and C.2.(d) in the title deed of the property T35242/2025, relating to one dwelling only, ½ built upon area and the street, rear and lateral boundary building lines.
  • Deletion of conditions of an existing approval imposed in terms of the Townships Ordinance No 33 of 1934 relating to one building only, ½ built upon area and the street, rear and lateral boundary building lines.
  • The following departures from the Development Management Scheme:

    I. Item 22(c)(ii): To permit the dwelling house located within 3 m of the western common boundary to measure 6,45 m in lieu of 4 m above existing ground level.

    II. Item 22(c)(ii): To permit the dwelling house located within 3 m of the eastern common boundary to measure 7,34 m in lieu of 4 m above existing ground level.

    III. Item 22(d): To permit the dwelling house to be setback 1,73 m in lieu of 3 m from the western common boundary.

    IV. Item 22(d): To permit the dwelling house to be setback 1,73 m in lieu of 3 m from the eastern common boundary.

    V. Item 140 (1)(b): To permit the carriageway crossing to be 7,6 m in lieu of 10 from the intersection.

    VI. Item 140(2)(a): To permit two carriageway crossings along Milner Road.

    VII. Item 140(2)(b): To permit two carriageway crossings to be located 10,7 m apart in lieu of the required 12 m.

    VIII. Item 121(2): To permit the structures to be setback 3,5 m in lieu of 5 m from a designated metropolitan road.
