UNANIMOUSLY RESOLVED that proposed closure of City-owned immovable property: portions of a public place being portion of erven 734, 735 and 737 Vredehoek situated on Noordelik Avenue, Vredehoek BE DEFERRED the transfer of a portions of Erven 734,735 and 737 Vredehoek (Public Place) situated Noordelike Avenue, Vredehoek, in extent approximately 37m², shown hatched and lettered ABCDE, on the attached Plan STC 3211 marked ( Annexure “A”), to Alexander and Anna Belen Stewart, or their successor(s) title, BE DEFERRED for the following reasons:

Property department to request Land Use Management to submit a report reflecting the building plans of the said property, including the deck

building inspector to do an onsite inspection.
RESOLVED THAT IT BE RECOMMENDED THAT:

Council resolve that, in terms of section 14 of the Local Government: Municipal Finance Management Act, Act 56 of 2003, that the subject property being portions of Erven 734,735 and 737 Vredehoek( Public Place) situated at Noordelik Avenue, Vredehoek, in extent approximately 37m² , shown hatched and lettered ABC on the Plan STC 3211 ( Annexure “A” attached to the report) is not required to provide the minimum level of basic municipal services; and has considered the fair market value of the asset and the economic and community value to be received in exchange for the asset;

Council approve the granting of in-principle approval in terms of regulation 5(1) (b)(ii) of the Municipal Asset Transfer Regulations for the transfer portions of Erven 734,735 and 737 ( Public Place) situated at Noordelik Avenue, Vredehoek, in extent approximately 37m², shown hatched and lettered ABC on the Plan STC 3211 ( marked Annexure ‘A’ attached to the report)

Council, in terms of section 4 of the City of Cape Town Immovable Property By-Law,2015, approve of the closure of the subject property being portions of Erven 734,735 and 737 ( Public Place)situated at Noordelik Avenue, Vredehoek, in extent approximately 37m², shown hatched and lettered ABCDE on the Plan STC 3211 marked Annexure ‘A’ attached to the report

That the transfer of a portion of Erven 734,735 and 737 Vredehoek ( Public Place) in extent approximately 37m², shown hatched and lettered ABCDE on the attached Plan STC 3211 marked Annexure ‘A’, to Alexander and Anna Belen Stewart or their successor(s) in title ,be approved, subject to the following conditions, that

A purchase price R415.00 excluding VAT be payable.

The purchase price is to be escalated by 8% per annum compounded annually on a pro-rata basis, commencing 6 months from date of valuation, i.e. from 1 February 2018, until date of registration;

The valuation is to reviewed if the transaction is not implemented within 18 months from of date valuation,i.e. by August 2019;

Rates and municipal charges, if applicable, be levied.
