Mr. Strumpher advised that a demolition is, in terms of the MFMA, construed as a “disposal” of an immovable asset. Council needs to take a decision in terms of s14 of the MFMA that such asset is not required for any municipal purpose. The four kiosks were found to be in a good condition and valued at R50 000 each and demolition valued at R220 000. Every demolition report has a clause that council needs to confirm that an asset is not required for any municipal use. Initially it was not required but lately the trading kiosks at all PTI’s are now part of the Urban Mobility Directorate mandate. The Enterprise and Investment Department indicated that they will take over the trading kiosks and investigate the upgrading of the kiosks to make it suitable for food preparation.
The Chairperson mentioned that the 4 trading kiosks have been problematic for years and no enforcement is being done. She enquired from Mr. Mchunu if the informal trading plan will include open trading bays where the kiosks are currently located.
Mr. Mchunu reported that they plotted 20 open trading bays in the space where the trading kiosks will be demolished.
The Chairperson indicated that the approval of the trading plan will be delayed if the kiosks are not demolished.
Ms. Jansen mentioned that Mr. Greyling indicated that the balance of the trading kiosks will be taken over by the Enterprise and Investment Department but not the four kiosks intended for demolishment. Ms. Jansen requested clarification from Mr. Mchunu whether Enterprise and Investment are interested in the 4 trading kiosks to which the answer was no.
The Chairperson recommended the following;
That Mr. Le Fleur advise on the total cost spent on refurbishment and maintenance of the four trading kiosks;
That the Subcouncil be included in all discussions and meetings regarding the kiosks;
That the information requested be given at the BACTT meeting.
RESOLVED That the item remains on the Matters Receiving Attention until resolved.
That Ms. Jansen will set up a skype meeting with the Chairperson, Cllr Visser, Messrs. Greyling, Le Fleur, Mchunu and Strumpher
