RESOLVED UNANIMOUSLY:

That an administrative penalty of R 5 000.00 for the unauthorised building work BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 103659 Maitland.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out below

1. The gravity is not serious despite the buildings being erected on the street boundary, but do intruded onto the street boundary which warrants a higher penalty
2. The buildings are not out of character since other properties have buildings is similar locations on properties.
3. There will be no change to the character of the site or the streetscape as the buildings already exist on the site.
4. The owner wishes to remedy this situation and will comply with the requirements of the City by submitting building plans in terms of the National Building Regulations and Building Standards Act No 103 of 1977).
5. That council should adhere to their own rules
