UNANIMOUSLY RESOLVED that:
a. The removal of the restrictive title deed condition B.1.(a) in respect of erf 19401, Milnerton, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015.
b. The amendment of the original town establishment condition as set out in Annexure A in respect of erf 19401, Milnerton, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015.
c. The rezoning of erven 3635 and 19401, Milnerton, from General Residential Subzone 3 (GR3) to General Business Subzone 1 (GB1) BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. The consolidation of erven 3635 and 19401, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
2.6 The owner shall pay a financial contribution towards roads, municipal services, stormwater and transport in the amount of R 769 055.58, or as agreed with the relevant departments, in accordance with the relevant policy. Such payment shall be made within 30 days of the approval of the land use application or prior to building plan approval for the change in use.
