UNANIMOUSLY RESOLVED that:
a. The application for departures with respect to erf 152677, Cape Town, 5B Carisbrook Street, Longkloof Precinct, Gardens, in respect of Item 137 of the DMS: to permit 16 off-street parking bays in lieu of 87 parking bays BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for City Approval in respect of Item 138 of the DMS: To permit alternative parking supply by means of a notarial servitude, with 16 structured bays to be accommodated on Erf 96229 Cape Town and Item 162 of the DMS: To permit work in a Heritage Protection Overlay Zone (HPOZ) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. The application for Deletion of an existing condition of approval for Subdivision, with reference to the 199 and 3 approved plan No. SE 13594/1 which reads: “Any development to the existing building on Portion 4 (Building 14) shall be limited to its present envelope” to BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. The application for Permission in terms of an existing condition of approval to use the building on Portion 4 (as shown on the 1993 approved plan with reference SE 13594/1) for ‘office, school, restaurant and shop’ purposes in lieu of ‘office and school’, as currently approved as set out in Annexure A on Erf 152677 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:
7.1.14 The development is supported by Heritage Western Cape and internal departments
1.3 Item 162 of the DMS: To permit work in a Heritage Protection Overlay Zone (HPOZ) to be generally in accordance with Annexure C
3. Land Use Management:
3.1 The SDP shall include a landscape plan as required in terms Item 123 of the DMS
3.2 The SDP shall make clear provision for a northern pedestrian connection to Bree Street through the adjacent erf as per approved development proposals on that erf. The SDP shall specifically indicate conformance with Item 123(2) subsection Q (q) and subsection R (r). This linkage to be activated at the time that the Canning site is operational
