UNANIMOUSLY RESOLVED that:
a. The application for subdivision into two portions, as set out in Annexure A, for erf 4164, Pinelands, indicated in Annexure C, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.
b. The application for departures, as set out in Annexure A, in respect of erf 4164, Pinelands, as indicated in Annexure D, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:
7.9 Departures from the Special Zone A Howard Place provisions are considered to be appropriate, particularly given the location of the site
Correct 7.5 to read as follows:
The proposed five storey mixed use development is considered to be of an appropriate scale and form and is considered to be compatible with the surrounding land uses;
Add to Annexure A: New Condition
Traffic modelling required for Forest Drive, Howard Drive and Avonduur Road intersections, to assess the impact of the development on the signal timing and phasing plans at this intersection, shall be presented to the relevant department (TNID) prior to the submission of building plans, unless determined otherwise by the authorised official
Amend 2.2 to read as follows:
A landscaping plan shall be submitted for approval prior to the submission of building plans, and shall address the treatment of all street facades by means of landscaping and architectural treatments.
Add: The Stormwater Policy shall be complied with
NOTE: The DC must be used as a matter of urgency to address congestion concerns along Howard Drive and Forest Drive
NOTE: The developer shall consider incorporating appropriate water and energy efficient techniques in the final building design
Parties were advised of their right of appeal.
