UNANIMOUSLY RESOLVED that:
The regulation departure from the 3m common boundary building line to 0m to permit a garage of 3.975m in lieu of 3.5m in height on erf 19333, 5 Saxon Crescent, Milnerton, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015, in accordance with plan no 10001/01-WIP2017/03/Abantuspace/08/07/2019, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT REFUSED the application for the following reasons.
The proposal will have a negative impact on the northern side of the neighbour’s property and will obstruct views
No motivation is provided for the increase in height
