Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for consent use to permit a rooftop base telecommunication station to be erected on erf 20512, Brooklyn BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

b. The application for regulation departure from item 41(e) of the Development Management Scheme to permit the rooftop base telecommunication station to be erected at 0m in lieu of 4.5m from common boundary BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015

c. The application for City approval in respect of rooftop base telecommunication station extending more than 3m in height above the part of the existing outbuilding to which it is proposed to be attached BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to add:

7.5 The MPT considers this application to be an attempt to evade the intent of the Development Management Scheme because it purports to be a tower rather than a rooftop cell mast
