Ref 70488482 - Consolidation, removal of title deed restrictions, consent in terms of a restrictive title deed condition and permanent departures<span> <h2 class="sectHeading">​​​​​​​​​​App​lication details​​​​​​​​</h2></span> <p>District office: <a href="http://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/TDA%20DM%20-%20Contacts.pdf" target="_blank">Table Bay District</a><br> Application number: 70488482<br> Applicant / owner details: Tommy Brummer CC / Simcha Trust and Artmell Trust.<br> Description and physical address: 1A and 3 Beta Close, Camps Bay.<br> Submission period: 6 November 2020 - 18 January 2021</p><h2 class="sectHeading">​​​​​​​​​​Purpose of the application​​​​​​</h2><p>The proposal entails the demolition of the existing dwellings on Erven 68 and 69, Camps Bay and proposes to construct a single dwelling on the consolidated site.</p><p>The following applications are required to permit the development of the new dwelling house on the consolidated site and are accordingly submitted in terms of the provisions of the Municipal Planning By-Law (“By-Law”): </p><ol><li>1. In terms of Section 42(f) of the By-Law for the consolidation of Erf 68 and Erf 69, Camps Bay. </li><li> 2. In terms of Section 42(g) of the By-law for the deletion of the following title deed conditions: </li><li> 2.1 From Deed of Transfer T24304/2008 for Erf 68:  <br><span style="text-decoration:underline;">Condition C (n) 2:</span> That any building to be erected on this property shall stand back from the boundary of the street on which the Lot may front or abut not less than 4,72 metre from the Victoria Road and not less than 4,72 metre from both the 1,57 metre and the 5,67 metre passages shown on the plan. The space thus left may be used as gardens and forecourts, but shall not be built upon. </li><li> 2.2 From Deed of Transfer T11456/2018 for Erf 69:  <br><span style="text-decoration:underline;">Condition C (m) 2:</span> That any building to be erected on this property shall stand back from the boundary of the street on which the Lot may front or abut not less than 4,72 metre from Victoria Road and not less than 4,72 metre from both the 1,57 metre and the 5,67 metre passages shown on the plan. The space thus left may be used as gardens and forecourts, but shall not be built upon. </li><li> 3. In terms of Section 42(h) of the By-law for the consent of Council as required by Title Deed Conditions C (n) 1 and C (m) (1) to exceed the built upon area of the consolidated property and permit a coverage of 55%. </li><li> 4.
