Urban Development Edge: NEMA Urban Area incentives

The City’s Urban Development Edge (UDE)

Council approved the City’s Urban Development Edge (UDE) at its meeting on 26 January 2023.

The Urban Development Edge (UDE) forms part of:

The City’s Urban Development Edge demarcates the boundary of the outer edge of the future city, including:

  • farms and rural areas that are not yet developed; and
  • areas that are located outside of the current built-up area.

It reflects an estimate of the land that is likely to be required for new urban development over the next 5-20 years. The demarcation assumes that the land will be developed for conventional urban uses such as residential, business, industrial and community uses.

Please note

Some land parcels in the Table Mountain National Park will be excluded from the Urban Areas exemptions.

Adoption of a National Environmental Management Act (NEMA) Urban Area for Cape Town

The City proposed that the Provincial Government’s Department of Environmental Affairs and Development Planning (DEA&DP), as the competent authority, formally adopt the area within the City’s approved Urban Development Edge as a NEMA Urban Area with respect to the National Environmental Act (NEMA), Act 107 of 1998.

DEA&DP invited the public to comment on the proposed adoption of a NEMA Urban Area for Cape Town in 2024 and 2025. This commenting process did not include comments on the City’s Urban Development Edge.

The adoption of the area within the Urban Development Edge as a NEMA Urban Area aims to simplify and align policy and legislation.

About the process

Advertisements, consultations with the public and negotiations with the National Department of Environmental Affairs and legal departments took place between 2023 and 2025.

Western Cape Province gazetted the adoption of the UDE on 15 July 2025. [Gazette No. 9104]. The formal adoption of the City’s Urban Development Edge as the boundary for an adopted NEMA Urban Area will result in easier, faster and more consistent decision-making in terms of applicable Listed Activities, particularly in areas where the City’s Urban Development Edge has expanded outwards.

Now that DEA&DP has adopted the City’s Urban Development Edge, the area within it becomes a NEMA Urban Area.

The Urban Area line will be advertised every five years, along with the process to update or revise the Municipal Spatial Development Framework and other spatial policies during which the Urban Development Edge is also reviewed.

Why is the NEMA Urban Area important?

A NEMA Urban Area may include land use, which includes certain Listed Activities in the Environmental Impact Assessment Regulations, 2014, as amended, that will require environmental authorisation before being implemented.

Some of these Listed Activities do not require an environmental authorisation if they are intended to take place within an urban area. At present, the competent authority (DEA&DP) decides on whether an area is to be considered an ‘urban area’ or not based on the location of the listed activity ‘within the edge of built-up areas.

The adoption of the Urban Development Edge and a NEMA Urban Area within it by the DEA&DP ensures that a large group of land parcels, which are outside the existing built-up area, could be developed without an environmental authorisation requirement, if it is clear that no other Listed Activities trigger the requirement for an environmental authorisation.

Benefits of the NEMA EMFs and Urban Area

  • The adoption of a NEMA Urban Area for Cape Town is particularly important for Environmental Impact Practitioners. It will now be easier for the DEA&DP as the competent authority, property owners, residents and professionals to determine whether an environmental impact assessment is required for development on land that falls within the Urban Development Edge (UDE)
  • Undeveloped land in or on the edge of developed areas often does not have bulk services or the capacity needed for basic services such as water, sanitation, transport, and electricity provision
  • These areas being mostly agricultural, rarely have any environmental features or habitats which would trigger the requirement for an environmental authorisation. In these areas the Urban Area exclusion provision will enable investment and service delivery without the need for an Environmental Impact Assessment
  • The Urban Area exclusion provision reduces the number of environmental authorisations required, and facilitates services provision, particularly in new areas that are included in the UDE
  • This will save time and costs
  • The Urban Area exclusion provides a list of activities that are excluded from requiring authorisation when located within a NEMA Urban Area, however, if the land has features such as a river, stream, wetland, and core biodiversity, or if the area is of agricultural significance, then other legislative requirements will apply, for example Water Use Licences or other requirements in terms of the National Water Act and the City’s Municipal Planning By-law and policies
