City delivered materials to Khayelitsha unlawful occupiers as per court order

7 January 2021

The City of Cape Town notes the recent allegations made by Human Settlements Minister Lindiwe Sisulu.

The City has never refused to hand out building materials.

In fact, the City of Cape Town delivered material to the 49 households, which unlawfully occupied a piece of land in Khayelitsha by the date stipulated in the court order.

This was in adherence to the court’s directive for temporary relief for these unlawful occupiers during the remainder of the COVID-19 crisis.

The occupiers however wanted new material. The City was not ordered by the Court to provide new material. The City was ordered to return only what was confiscated.

In response to their wishes and the Legal Resources Centre’s letter, the City offered to provide unclaimed materials from its stores. This was then delivered on 22 April 2020 to the 49 unlawful occupiers for temporary accommodation.
