Resolution detail

RESOLVED that:
 
Subcouncil 20 recommended that the lease of a portion of a public place and public street, being portions of Erven 83195 and 83196 Cape Town, situated between Uithof Street and Main Road Steenberg, shown lettered ABCD on the attached plan
130004332 marked Annexure A, in extent approximately 270 m², to Cherryvest
Eight Proprietary Limited, owner of Erf 110951 Cape Town or his successor in
title, be approved subject, to inter alia the following conditions, that:
 
  1. A market rental of R6 000.00 per month inclusive of rates and excluding VAT calculated at the rate applicable at the time of transaction be payable;
 
  1. The rental shall escalate at 6% per annum compounded annually on a pro rata basis commencing 6 months after date of valuation, i.e. as from 2022-02-01,
 
  1. The lease will endure for a period of 10 (ten)years; subject to a rental review after a period of 5 (five) years;
 
  1. The property be used for parking purposes only;
 
  1. Any boundary fencing is to be of a non-permanent visually permeable boundary (palisade fencing) type and will be subject to:
 
  1. The submission and approval of necessary building plans in terms of the National building regulations if applicable.
 
  1. Any fencing that does not require the submission of plans in terms of National building regulations will still require the approval of the Director of Property Management
 
  1. No direct vehicular access / egress via PMR 101 is allowed; BE AMENDED AS RESOLVED BY SUBCOUNCIL 20
 
  1. Electricity services exist within the vicinity of the lease area and the following conditions will apply:
 
  1. Any alteration or deviation to Electricity services necessary as a consequences of the proposal or requested by the Lessee will be carried out at the Lessee’s costs.
 
  1. Electrical infrastructure may exist on the property or in its vicinity. A wayleave shall be obtained from the Electricity Generation Department before any excavation work may commence. In this regard, please contact the Drawing and Record Centre office South Telephone

  1. Adherence to the requirements of the City of Cape Town’s water by – law
 
  1. Subject to such further conditions imposed by the Director: Property Management in terms of their delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property;
 
  • All outstanding accounts with the City of Cape Town be settled.
 
 
Subcouncil 20 further RESOLVED that:
 
Condition (f) of the annexure be amended as follow:
 
f)  Direct vehicular access / egress via PMR 101 is allowed.
