• Cllr Cassiem informed the members of the Subcouncil that he and the relevant official, Saul Jacobs engaged the abutting neighbours about the proposed closure of portion of Erf 36441 off Welby road Athlone.
• The Subcouncil members once again recommended that specific request for property related matters to be advertised in local newspapers so that community is not excluded in the public participation process in lign with provisions of Section 21(a) & (b) of the Municipal Systems Act No.32 of 20000
The Subcouncil members unanimously SUPPORTED the recommendation that:
a) Council resolve in terms of section 14 of Local Government: Municipal finance Management Act, Act 56 of 2003, that a portion of Erf 36441 Cape Town (Public Street) situated off Welby Road , shown hatched and lettered ABCDEF, on the attached sketch STC 2197/1 marked annexure A is not required to provide the minimum level of basic municipal services; and has considered the fair market value of the asset and economic and community value to be received in exchange for the asset.
b) Council approve the granting of in-principle approval for disposal of portion of Erf 36441 Cape Town (Public Street) situated off Welby road , shown hatched and lettered ABCDEF attached as annexure A, in terms regulation 5(1)(b)(ii) of Municipal asset Transfer Regulations;
c) Council approve of the closure of a portion of Erf 36441 Cape Town (Public Street) situated off Welby road, shown hatched and lettered ABCDEF, on the attached sketch STC 2197/1 marked annexure A, in terms of section 4 of the City of Cape Town Immovable Property By-Law, 2015
