UNANIMOUSLY RESOLVED that:
a. The application for consolidation, as set out in Annexure A, on Remainder Erf 1428 and Erf 1429 Cape Town at Cape Town BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure D, subject to the conditions contained in the attached Annexure A.

b. The application for subdivision, as set out in Annexure A, of consolidated Remainder Erf 1428 and Erf 1429 Cape Town at Cape Town BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

c. The application for rezoning from Transport Zone 2 to General Business Subzoning 7 (GB7), on Portion B as indicated in Annexure B BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

d. The application for City approval in terms of the Development Management Scheme, as set out in Annexure A, on Remainder Erf 1428 and Erf 1429 Cape Town at Cape Town BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

e. The application for departures, as set out in Annexure A, on Remainder Erf 1428 and Erf 1429 Cape Town at Cape Town BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report

Annexure A:
Amend condition 2.25 as follows:
2.25 That the developer, at their cost, implements the following road upgrades to the satisfaction of the Director: Roads Infrastructure Management, prior to submission of an application for an occupancy certificate: Buitengracht Street/ Somerset Road/ Riebeek Street Intersection

Amend condition 2.8.2 as follows:
2.8.2. The approved landscaping plans in 2.7 above shall be implemented by and at the owner/developer’s cost prior to occupancy.

Amend condition 2.11 as follows:
2.11. The business premises component of the building shall have a minimum of 950m2 GLA on the first (ground) storey.

Renumber condition 3.5.1 to be 2.30 as follows:
2.30 Should the proposed vacant plot be utilized for a Residential Development (sectional title or cluster development/secured complexes/flats) or Shopping Mall/Complex/Centre or Office Complexes, Factories or Warehousing then a Refuse Room should be considered, prior to Section 37 clearance, to the satisfaction of the Director: Waste Services

Renumber condition 3.3.1 to be 2.27 and amend as follows:
2.27 In accordance with policy and tariffs approved by Council, a connection fee to provide a separate connection to the property boundary shall be paid to each portion, where applicable, prior to work commencing on site. The cable shall be routed clear of all other private property, typically within the public road reserve.

Renumber condition 3.4.1 to be 2.30 and amend as follows:
2.30 The property to be serviced with a sewer and water connection to the satisfaction of the Director: Water and Sanitation, prior to work commencing on site.
