RESOLVED UNANIMOUSLY that:

An administrative penalty in the amount of R2 500.00 BE DETERMINED in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 1304 Bergvliet with regard to the unauthorised building work in accordance with the plans drawn by Mack Architecture Urban Deisgn with drawing numbers 3.1 & 3.2, both revision H, both dated 22 February 2024.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, and added an additional reason 6.8 that reads as follows:

6.8. The buildings are not habitable and the visual impact is mitigated by the trees on the property hence the reduction in the penalty amount.
