RESOLVED that:

An administrative penalty in the amount of R0 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erven 83245 and 83246 Cape Town at Retreat in respect of the unauthorised institution as per plan drawn EMI South Africa, with project number ZA-0028, drawing number A 1-02, revision 4, dated 02/06/2022.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:

6.8. It would not be unreasonable for a lessee of City owned land to assume that the use of the land as specified in the lease would be lawful. This warrants a zero penalty amount.
