Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for subdivision of Erf 10544 Hout Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, as per plan of subdivision LUM/33/10544, subject to conditions contained in Annexure A.

b. The application for Council’s consent for Erf 10544 Hout Bay, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to conditions contained in Annexure A.
c. The application for a departure, as set out in Annexure A, for Erf 10544 Hout Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

Condition 2.4.1 is amended as follows:

2.4.1. A right of way and services servitude is to be registered over the Remainder in favour of Portion 1 as indicated on the plan of subdivision LUM/33/10544. That appropriate traffic management measures be implemented to address vehicular movement along the 4m wide servitude panhandle to the satisfaction of the Authorized Official.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:

7.15 The access via the 4m panhandle is the only practical access to these properties.
