Resolution detail

It is recommended that the lease of a portion of Public Place, Erf 15778 Milnerton abutting applicants's Erf 18972 Milnerton, Carisbrook Close West Beach Milnerton and as shown attached and lettered ABCD on the attached Pan NoTA 9610v0, marked annexure A, in extent approxiamately 334m to Dean Kannemeyer, the owner of Erf 18972 Milnerton, or his successors in ttle be approved subject inter alia to the following conditions that:

a) A tariff rental of R2 089,57 per annum excluding VAt calculated at the rate applicable as the time of transaction be payable. rates not applicable;
b) The lease will endure for a period of ten years;
c) The rental will be adjusted annually in terms of the renal tariff structures as approved by Council;
d) The property be used for garden and security purpose only;
e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f) Subject to compliance with any other statutory requirements;
g) No compensation will be payable for any improvement made to the property;
h) All outstanding accounts with the City of Cape Town must be settled;
i) The applicant will obtain written approval from the Director: Recreation and Parks should he wish to install any landscaping or additioal security measures ( in addition to the existing vibrecte wall.)
j) No trees within the lease area may be removed without prior approval from the Director: Recreation and Parks (or duly authoried official). In the event of trees being removed without written permission from an authoried official, the applicant will be contravention of the Streets, Public Place and the Prevention of Nosie Nuisances By-Law and any other applicable legislation and my be prosecuted and/or liable for any replacement or rehabilitation measures as determined by a authorised official.
