RESOLVED that:
An administrative penalty in the amount of R 20 000.00 for the unauthorised land use (scrap yard and vehicle showroom), BE DETERMINED In terms of Section 129 of the City of Cape Town Municipal Planning Amendment By-Law, 2019, in respect of Erf 268, 31 Hindle Road, Highgate, Blue Downs.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend the following reasons:
6.3 The extent of the contravention is very large.
6.4 The gravity of the contravention is considered significant, given that no approval has been obtained from the Director: Environmental Health (City Health) and the Director: Fire and Rescue Services, or in terms of the NBR regulations.
6.5 The activity has been operating for a significant period of time and failed to cease the operation once informed that the activities were unauthorised.
Add new reasons as follows:
6.6 The property is located on what will in future be a prominent road intersection. It is a visual blight on the landscape and detracts from the quality of the area. This warrants a significantly higher penalty
6.7 The use is a significant departure from what is permitted in an agricultural use zone
