UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 30 000.00 BE DETERMINED in terms of Section 98 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised change in use of the existing buildings on Erf 4264, Somerset West
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
These reasons warrant a reduction in the penalty:
- It was determined that some of the unauthorized work was done by the previous owner
- The property zone permits this activity, except that it deviated from the SDP.
- The building work is completed and has no additional negative impact
