UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 3 500.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 13983 Milnerton, in accordance with Drawing No. 120120001; dated 12-01-2020.

REASONS FOR DECISION
The MPT APPROVED the application for the following reasons:

6.1 The short operation duration of the ECD justifies a reduced penalty
6.2 The absence of any material negative impact on the surrounds or the character of the area also supports a reduced penalty
6.3 The gravity of the contravention is considered to be serious as children are potentially at risk
6.4 The applicant is experienced in ECD operations and should be aware of the regulations
