RESOLVED
It is recommended that:
It be NOTED that an application for a liquor licence received from EJ Liquors was considered in terms of sub delegated authority and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act, 2008, as amended:
Subcouncil 18 recommends that the application for a Consumption OFF Premises Liquor Licence, reference no. LLA24090001, for the business EJ Liquors at 11 Peppershrike Pelikan Park NOT BE SUPPORTED.
At the Sub delegated meeting held on 23 September 2024, Subcouncil 18 does not support the application based on the following:
• That it is not in the best interest of the Community and based on the comments received from Town Planning, Law Enforcement, community organisations and residents.
• The comments received from Town Planning that they do not support the subject property is zoned for Single Residential zone (SR1) in terms of the Municipal Planning By- Law, 2015, which does not permit the sale of alcoholic beverages. The owner submitted a land use application which was not accepted as a submission. Therefore, there are no land use rights in place to permit the intended activity.
• Law Enforcement does not support based on the Premises zoned as SR1(not allowing sells of alcohol) Form 3 displayed Premises applied for Consumption off Renovations must still take place Business will utilize Public Road for loading and offloading applicant was informed to comply according to the City By Laws and trading hours determined by the City. Not supporting the application they must still apply for rezoning 13/09/2024.
Objections received from local resident and Community Organisations:
• Objection 1- hereby vehemently objects to this application. The location of this applicant is close to the bus route and between the Pelican Park High School and the Pelican Park Primary School. This liquor outlet would impact negatively on the community which is already hard hit by crime and unemployment. We do not wish to further impact negatively on the social fabric of the community of Pelican Park.
• Objection2: This is a residential area where we have so many kids, that is already under privileged due to Drugs and Alcohol abuse. I do not support this application. By allowing this would increase violence, injuries, accidents, child abuse, intimate partner violence and it will promote underage drinking as well that will lead to more unwanted teenage pregnancies. By granting this application you would be allowing the applicant a window to destroy this community even more.
