Resolution detail

RESOLVED that,
 
Subcouncil 19 support the Informal Trading Plan for Simon’s Town, and recommends that the Executive Mayor together with the Members of the Mayoral Committee recommend to Council that:
 

1. In terms of the process described in the Informal Trading By-law, that Council adopt the review of the Informal Trading Plan for Simon’s Town as indicated in the attached annexures A to H;

2. The area indicated in Annexure A to be a declared area in which the carrying on of the business of street vendors, peddlers or hawkers is prohibited, with the exception of the informal trading bays indicated in the plan in Annexures B to E;

3. The informal trading bays indicated in Annexures B to E to be declared areas that are restricted to persons without a valid informal trading permit issued by the City of Cape Town;

4. The informal trading bays indicated in Annexures B to E to be let out by means of a permit system and that no street vending, peddling or hawking be permitted in these demarcated informal trading bays without a valid permit for the proposed informal trading bays; Subcouncil 19: Review of the Informal Trading Plan for Simon’s Town 3 March 2024

5. The special trading conditions listed in Annexure F to apply to informal trading permits issued for the demarcated informal trading bays;

6. The two areas indicated in Annexure G and Annexure H be demarcated as markets as per section 5.3.4 of the Informal Trading By-Law;

7. The comments received during the public participation process, listed in Annexure J, be noted and the responses provided by Area Economic Development be supported.

8. The objections received during the public participation process, listed in Annexure J, be not upheld for the reasons stated in the report.

1. In terms of the provisions of the Businesses Act, Act 71 of 1991, Council to revoke the proclamation published in the Province of the Western Cape: Provincial Gazette Notice 5311 dated 27 November 1998; and j) The revised informal trading plan, as approved, be published in the Provincial Gazette in terms of the Informal Trading By-Law.
