Not delegated: for decision by Council:
It is recommended that the Subcouncil recommend (in terms of Subcouncil delegation) that the Executive Mayor, together with the Mayoral Committee, recommend to Council that:
 

  1. Based on the process prescribed in the Informal Trading By-Law Council adopts an informal trading plan for Subcouncil 3 as indicated in the attached Annexures A through to Annexure Q.
 
  1. The area indicated in Annexures A through to Annexure Q which is the area of Sub-council 3 be declared an area in which the carrying of the business of street vendor, peddler, or hawker is prohibited, with the exception of the informal trading bays reflected in Annexures A through to Annexure Q.
 
  1. The areas indicated on Annexures A through to Annexure Q be declared as areas that are restricted to persons in possession of a valid informal trading permit issued by the City of Cape Town for the particular trading spaces.
 
D.  The trading bays mentioned in Annexures A through to Annexure Q be let out by means of a permit system. No Street vending, peddling or hawking are permitted in these informal trading bays if a person is not in possession of a valid permit for the particular trading spaces.
 
E.  The trading hours for all approved informal trading sites be approved from 06:00 to 19:00 - Monday to Sunday.
 
F.  The size of all the bays would range between 3 to 6 metres, and may be adjusted based on the need and prevailing conditions of the sites. Sub-council 3 note the comments (Annexure T) from the external public participation process collected during the comment period which ran from 29 August 2022 until 30 September 2022 and support the responses provided by Area Economic Development.
 
G)  Sub-council 3 supports and recommends to the Executive Mayor together with Mayco that they recommend to Council that the objections  contained in this report be not upheld for the reasons stated in the report.
