RESOLVED
It is recommended that:
(a) Council resolve that, in terms of section 14 of the Local Government:
Municipal Finance Management Act, Act 56 of 2003, Erf 59096 Cape
Town, as indicated as on the attached plan marked Annexure A, is not
required to provide the minimum level of basic municipal services; and
the fair market value of the asset and the community value to be received
in exchange for the asset by means of demolition are greater than
retaining the asset in its current dilapidated state. The asset (land) is an
integral part of the future Jan Smuts Road Widening Scheme Plan, and
forms part of the City’s transport approved 2017 to 2022 City’s integrated
Transport Plan (CITP);
(b) Council grants in-principle approval in terms of regulation 5(1)(b)(ii) of the
Municipal Asset Transfer Regulations for the disposal by way of
demolition a portion of Erf 59096 Cape Town, as indicated as on the
attached plan marked Annexure A;
(c) Council approve the disposal by way of demolition of the structures on
City owned land, a portion of Erf 59096 Cape Town, as indicated as on
the attached plan marked Annexure A, subject thereto:
(i) that the on-site trees be retained.
(ii) that the demolition costs be provided for by the Corporate
Facilities Management Department
