RESOLVED to RECOMMEND  that:
 
In respect of the hatched figure lettered ABCD on the attached Plan 130003551:
 
a) Council resolve that, in terms of section 14 of the Local Government: Municipal
    Finance Management Act, Act 56 of 2003, the subject property being a
     portion of Erf 98 Tamboerskloof (Public Street), situated at Devon Port Road,
    Tamboerskloof, in extent approximately 9 m² shown              by the hatched figure
    lettered ABCD on the Plan 130003551 (Annexure “A”) attached to the plan
    is not required to provide the minimum level of basic municipal services; and
    has considered the fair market value of the asset and the economic and
    community value to be received in exchange for the asset;
 
    b) Council approve the granting of in-principle approval, in terms of regulation
        5(1)(b)(ii) of the Municipal Asset Transfer Regulations, for the granting of rights
         to use and control or manage municipal capital assets by way of granting a
         building rights servitude under a portion of Erf 98 Tamboerskloof (Public Street),
        situated at Devon Port Road, Tamboerskloof, in extent approximately 9 m²,
        shown  by the hatched figure lettered ABCD, on the attached Plan 130003551
        (Annexure “A”) which represents an underground access tunnel;
 
  c)  The granting of rights to use and control or manage municipal capital assets by
       way of granting a building rights servitude over a portion of Erf 98
       Tamboerskloof (Public  Street), situated at Devon Port Road, Tamboerskloof, in
       extent approximately 9 m², shown  by the hatched figure lettered ABCD, on the
       attached Plan 130003551 (Annexure “A”) in favour of Erf 356 Tamboerskloof
        to Peter Arnold, or  his successor(s) in title, be approved, subject to the below
       mentioned conditions:
 
                 i) A compensation amount of R50 625, excluding VAT be payable;
 
                ii) The  compensation amount is to escalate at 5% per annum
                    compounded annually on a pro-rata basis commencing 6 months from
                    date of valuation (i.e. as from 1 April 2023) until date of registration;
         
               iii) That the  amount be reassessed if the transaction is not approved
                   within 36 months from date of valuation, i.e. 30 September 2025.
 
                 iv) The hatched figure lettered ABCD, on the attached Plan 130003551
                      is to be used for underground access purposes only.
 
                 v) Rates and municipal charges, if applicable, be levied.
 
                 vi) Subject to such further conditions to be imposed by the Director:                                                                                                                                                                                                                                                                                                                                                                 Property Management in terms of her delegated authority, including
                      inter alia the following:
 
                          aa)   that all further statutory and land use requirements be complied with;
 
                          bb)   that all costs related and incidental to the transaction be  borne by the purchaser
 
                vii) The objection by the Environmental and Heritage Management
                      Branch not be upheld
 
 
In respect of the hatched figure lettered EFGC on the attached Plan 130003551:
 

  1. Council resolve that, in terms of section 14 of the Local Government: Municipal Finance Management Act, Act 56 of 2003, the subject property being a portion of Public Street, Erf 98 Tamboerskloof situated on Devon Port Road, Tamboerskloof, in extent approximately 37m², shown hatched and lettered EFGC on the attached plan 130003551 marked as Annexure A is not required to provide the minimum level of basic municipal services; and has considered the fair market value of the asset and the economic and community value to be received in exchange for the asset;
 
  1. Council approve the granting of in-principle approval, in terms of regulation 5(1)(b)(ii) of the Municipal Asset Transfer Regulations, for the transfer of a portion of Public Street, Erf 98 Tamboerskloof situated on Devon Port Road, Tamboerskloof, in extent approximately 37m², shown hatched and lettered EFGC on the attached plan 130003551 marked as Annexure A;
 
  1. Council in terms of Section 4 of the City of Cape Town Immovable Property By-Law, 2015, approve of the closure of the subject property being a portion of Public Street, Erf 98 situated on Devon Port Road, Tamboerskloof in extent approximately 37m², shown hatched and lettered EFGC on the attached plan 130003551 marked as Annexure A
 
  1. That the transfer of a portion of Public Street, Erf 98 Tamboerskloof, situated at Devon Port Road, Tamboerskloof, in extent approximately 37 m², shown  by the hatched figure lettered EFGC, on the attached Plan 130003551 (Annexure “A”) in favour of  Erf 356 Tamboerskloof to Peter Arnold, or  his successor(s) in title, be approved, subject to the below mentioned conditions.
 
         i) A purchases price of R277 500, excluding VAT be payable;
 
         ii)The purchase price is to escalate at 5% per annum compounded
            annually on a pro-rata basis commencing 6 months from date of
            valuation (i.e. as from 1 April 2023) until date of registration;
 
         iii) That the market value be reassessed if the transaction is not
             approved within 36 months from date of valuation, i.e. 30
             September 2025.
 
         iv) The hatched figure lettered EFGC on the attached Plan 130003551
              is to be used for the construction of one level garage only;
 
         v)  Rates and municipal charges, if applicable, be levied.
 
        vi) Subject to such further conditions to be imposed by the Director:    
                                                                                                                                                                                                                                               Property Management in terms of her delegated authority, including
            inter alia the following:
 
aa)   that all further statutory and land use requirements be complied with;
 
bb)   that all costs related and incidental to the transaction be  borne by the purchaser
 
cc)    A servitude over the 150mm sewer main must be registered against the title deed of the property
 
dd)   The hatched figure lettered EFGC on the attached Plan 130003551 is to be notarially tied to the applicant’s Erf 356 Tamboerskloof.
      vii) The objection by the Environmental and Heritage Management  Branch not be upheld
