Subcouncil 4 resolved that the lease of a portion of City-owned land, being a portion of the Remainder of Erf 101501 Cape Town, bounded by Bofors Circle, Carrier Way, and Valhalla Drive, Epping 2, Cape Town, as shown hatched and lettered ABCD on the Plan No 130007905 attached and marked Annexure A, in extent approximately 5 170 m², to The Cart Horse Protection Association, a non-profit organisation registered under Registration Number 005-761 NPO, or its successors-in-title, BE APPROVED, subject to inter alia the following conditions, that:
 
  1. A tariff rental of R995, 65 per annum, excluding VAT calculated at the rate applicable at the time of the transaction, be payable. Rates are not applicable;
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. The lease will endure for ten years, with an option to renew for a further period;
 
  1. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. The property may only be used for housing the offices and operations of the applicant and for no other purpose whatsoever;
 
  1. No compensation will be payable for any improvement made to the property;
 
  1. The tariff rental assumes that the Lessee will be responsible for all maintenance and repairs of the premises;
 
  1. No permanent structures may be erected on the property.
