A vote was taken and Subcouncil 20 unanimously supported the recommendation.
RESOLVED TO RECOMMEND
Subcouncil 20 supports the lease of public street, being a portion of Erf 652 Hout Bay situated at Clyde Street, Hout Bay, shown hatched and lettered ABCD on the attached plan 130008600 marked, Annexure A, in extent approximately 252 m², to Simone Monika Bruckner, owner of Erf 3053 or her successors in title be approved subject to inter alia the following conditions, that:

A tariff rental of R1 695,65 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable.

The lease will endure for a period of ten years with the option to renew for a further ten years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for gardening and security purposes only and no structure other than the existing structures and fencing will be permitted within the lease footprint;

Subject to such further conditions to be imposed by the Director; Property Management in terms of her delegated authority;
-
Subject to compliance with any other statutory requirement;

No compensation will be payable for any improvement made to the property;

Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant will be carried out at the applicant’s cost;

Electricity infrastructure exists in the vicinity of the leased area. A way-leave must be obtained from the Electricity Generation and Distribution Department before any excavation work commences;

Should the lease be cancelled or required for road or stormwater purposes, the applicant will be required to reinstate the land to its original natural state, to the satisfaction of the Transport Directorate;

Pedestrian movement must not be negatively affected;
-
No permanent structures must be constructed over the stormwater chamber and pipe;
-
Access to the stormwater infrastructure is required for maintenance purposes;
-
No trees may be planted over the sewer
