Resolution detail

 RESOLVED to RECOMMEND that the lease of portion of public street, being portions of erven 2844 and 7653 Hout Bay situated at Karbonkel Road, Hout Bay shown hatched and lettered ABCDE on the plan LT 1458v1 marked annexure A to the report, in extent approximately 1930 m², to The Peace and Mediation Forum, or its successors in title, BE APPROVED subject to inter alia the following conditions, that:
 

  1. A tariff rental of R883.48 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable.  Rates not applicable;
 
  1. The lease will endure for a period of ten years with an option to renew for a further ten years;
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. The property be used for Social Care/ Community purposes only and for no other purposes whatsoever ;
 
  1. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property;
 
  1. Adherence to the requirements of the City of Cape Town’s water by-law;
 
  1. A 100mm diameter water main exists within the vicinity of the proposed leased area and no construction, excavation or building works are to take place on or in close proximity of the existing water services;
 
  1. No trees/shrubs with invasive roots are to be planted within close proximity of existing water infrastructure;
 
  1. The Water Services Department will not be held liable for any damages incurred to structures and/or vehicles, due to unforeseen infrastructure repair and maintenance on and in surrounding area;
 
  • Electricity services exist within the vicinity of the lease area and any alterations or deviation to electricity services necessary as a consequence of the proposal or requested by applicant will be carried out at the applicant’s cost;
 
  1. A wayleave shall be obtained from the Electricity Services Department before any excavation work may commence, all excavation within 3m of the electrical services must be carried out under the direction of a representative of the Electricity Department;
 
  • Telkom services are known to exist within the lease area and it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
 
  • No mechanical plant or vibrator may be used within 3m of any plant (i.e. any Telecommunication equipment above or below ground level);
 
  1. It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times;
 
  1. If any plant indicated exists and information or supervision is required Telkom must be contacted;
 
  1. The refuse generated on the premises must be stored on the premises to the satisfaction of the Solid Waste Management Department;
 
  1. Any future developments must comply with Solid waste conditions;
 
  1. The Applicant must make use of all Solid Waste Services and will be responsible for the clean- up of the area.
