It is recommended that the lease of a portion of Public Street, being a portion of the Remainder of Erf 2612 Brackenfell, situated at Windhoek Way, Arauna, Brackenfell, as shown hatched and lettered ABCDE on the attached plan TA 1228v1 marked Annexure A, in extent approximately 76m², to Home Bound Investments (Pty) Ltd, owner of the adjacent Erf 2616 Brackenfell, or their successors-in-title, BE APPROVED, subject to inter alia the following conditions, that:
a) A tariff rental of R566,09 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
b) The lease will endure for a period of 10 years;
c) The rental will be adjusted annually in terms of the rental tariff
structure as approved by Council;
d) The property be used for garden and security purposes only;
e) Subject to such further conditions imposed by the Director: Property
Management in terms of her delegated authority;
f) Subject to compliance with any other statutory requirements;
g) No compensation will be payable for any improvement made to the property;
h) The water and sanitation infrastructure situated on the property must
be accessible at all times to the Water & Sanitation maintenance
personnel;
i) No construction of any structure or planting of additional trees will be
allowed on the water main;
j) The City will not be responsible for reinstatement costs of landscaped
areas if and when stormwater infrastructure or any other municipal
infrastructure is upgraded, maintained or replaced.
