Resolution detail

Subcouncil 6 supported and noted the report and recommended to the Director: Property Management that the lease of a portion of Public Place, being a portion of
Erf 3701 Parow situated at Edinburgh Road, Oostersee, Parow, shown hatched
and lettered ABCD on the attached plan TA 1009v1 marked annexure A to the report, in extent approximately 289m², to Fagma Stemmet, owner of Erf 3569 Parow or her successors in title, be approved subject, to inter alia the following conditions, that:
 
a)   A tariff rental of R1 695.65 per annum excluding VAT calculated at the rate
      applicable at the time of transaction be payable. Rates not applicable;
b)   The lease will endure for a period of 10 years;
c)   The rental will be adjusted annually in terms of the rental tariff structure as
      approved by Council;
d)   The property be used for gardening and security purposes only;
e)   Any alterations to electricity services necessary as a consequence of the
      proposal, or requested by the applicant, will be carried out at the applicant’s
      cost;
f)    No excavation is to take place on site without the possession of a wayleave
      and works permit from Electricity Services;
g)   The lessee shall be responsible at all times for the maintenance and good
      order of the land;
h)   On termination of the lease, the entire leased area must be reinstated at the
      lessee’s expense to a condition acceptable to the City of Cape Town;
i)    Access to water and sewer infrastructure to remain unrestricted should
      maintenance or pipe replacement be required;
j)    The ground surface over a water or sewer main shall not be altered in any
      way except with the prior approval of the Water and Sanitation Department;
k)   No trees shall be planted within 3m of the water and sewer mains;
l)    The City of Cape Town cannot be held liable for any damages or loss as a
      direct consequence of maintenance or replacement of existing infrastructure
      on the leased land;
m) Subject to such further conditions imposed by the Director: Property
      Management in terms of her delegated authority;
n)   Subject to compliance with any other statutory requirements;
o)   No compensation will be payable for any improvement made to the property;
p)   All outstanding accounts with the City of Cape Town must be settled.
