Wolfgat Subcouncil 12 RESOLVED to RECOMMEND that:
a) In terms of section 14(2)(a) and (b) of the Municipal Finance Management Act (MFMA), Act 56 of 2003:
i) Council resolve that the subject property erf 49947 Hazeldene Avenue, Mitchells Plain Zoned General Business 1 (GB 1) and
± 2014 m² in extent, shown in the attached locality (Annexure A), is not required for the provision of the minimum level of
basic municipal services;
ii) Council confirm that the fair market value of the asset described in (a) (i) and the economic and community value to
be received in exchange for the asset described have been considered;
b) Council grants in-principle approval in terms of regulation 5(1)(b)(ii) of the Municipal Asset Transfer Regulations for the
transfer of Erf 49947, situated at Hazeldene Avenue, Mitchells Plain in extent approximately 2014 m² as shown on the locality
map (Annexure “A”).
(c) Erf 49947, Hazeldene Avenue, Mitchells Plain be transferred via public competition , subject to conditions to be imposed by
the Director Property Management in the exercise of her delegated authority.
(d) That the objections received from the City’s Departments against the transfer of the property for community purposes
be upheld and that the property be transferred for business use as per its General Business (GB) zoning and at market
related prices.
e) That the objections received from the public against the transfer of the subject property at market related prices and
that the subject property be rezoned from General Business (GB1) to Community Use (CO1) not be upheld;
