Resolution detail

It was RESOLVED that Subcouncil 15 SUPPORTED the lease of portions of City-owned land, being portions of erven 479 and 10613 Milnerton, situated at the corner of Koeberg Road and Jansen Street, Milnerton, shown hatched and lettered ABCDEFGHJKLMN on the Plan No TA 258v1 and marked annexure A, attached to the report, in extent approximately 4 915 m2, to Milnerton Pre-Primary School or its successors in title, be approved subject to inter alia the following conditions:
 

  1. A market rental of R12 700,00 per month, excluding VAT and rates, calculated at the rate applicable as at the time of the transaction, be payable;
 
  1. The monthly rental is to be adjusted on the basis of 8% per annum compounded annually on a pro rata basis for the period 2017-12-01 until 2020-03-31;
 
  1. The escalation rate of 8% per annum was reduced to 6% per annum as from 01-04-2020 on account of the coronavirus and the resultant economic fallout which has dampened growth prospects for the property market. The rental will thus escalate at 6% per annum compounded annually on a pro rata basis as from 01-04-2020 until the lease contract is signed by the City of Cape Town;
 
  1. The rental is effective and payable two months from the date of valuation, i.e. as from 2021-03-01;
 
  1. The lease will endure for a period of 10 years;
 
  1. The property be used for educational purposes only;
 
  1. Subject to further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property;
 
  1. The boundary wall of the property must conform with the lease plan and must allow for the splayed corners required to ensure appropriate sight distance on Koeberg Road and Jansen Street, Milnerton;
 
  1. No additions or alterations, except for maintenance, may be undertaken on the property as the current use is a non-conforming use of the Public Open Space portion of the property;
 
  • The applicant will be responsible for all costs pertaining to the on-going maintenance of the property;
 
  1. Trees may not be felled or pruned without prior consultation with and approval from the Director: Recreation and Parks nor may such trees be damaged in any way;
 
  • The applicant must obtain approval from the Director: Recreation and Parks should they wish to introduce any landscaping and/or make any changes to the existing arrangement.
