RESOLVED TO RECOMMEND

Subcouncil 7 recommends that the Executive Mayor together with the Mayoral Committee recommend to Council that the following BE ENDORSED BASED on the process prescribed in the Informal Trading By-Law:

Based on the process prescribed in the Informal Trading By-Law Council adopts a revised informal trading plan for Durbanville as indicated in the attached Annexures A - L

The area indicated in Annexure A which is the area of Durbanville- Subcouncil 7 be declared an area in which the carrying on of the business of street vendor, peddler or hawker, is prohibited, with the exception of the informal trading bays reflected in Annexures B - L

The areas indicated on Annexures B-L be declared areas that are restricted to persons in possession of a valid informal trading permit issued by the City of Cape Town for the particular trading spaces.

The trading bays mentioned in Annexure B-L be let out by means of a permit system and that no street vending, peddling or hawking be permitted in these informal trading bays if a person is not in possession of a valid permit for the particular trading spaces.

The trading hours for all approved informal trading sites be from 06:00 to 19:00 from Mondays to Sundays.

The size of all the bays ranges from 4 square meters – 12 square meters and can be adjusted based on the need and prevailing conditions

Only two informal trading bays, number 21 and number 22 are earmarked for fast food traders at Durbanville Public Transport Interchange (Annexure B and C) and no selling of fast foods to be allowed on any other informal trading bay at Durbanville PTI.

Subcouncil 7 note the comments (annexure N) from the external public participation process held from 29th October 2020 – 30th November 2020 and support the responses provided by Area Economic Development.

Subcouncil 7 supports and recommends to the Executive Mayor, together with Mayco to recommend to Council that the objections contained in this report be not upheld for the reasons stated in the report.

The Informal Trading Plan for Durbanville Area which was promulgated in the Provincial Gazette Notice 7588, dated 1 April 2016, be revoked.

The approved informal trading plan be published in the Provincial Gazette in terms of the Informal Trading By-Law.
