It is recommended that the Subcouncil recommend (in terms of Subcouncil delegation) that the Executive Mayor together with the Mayoral Committee recommend to Council that:
 

1. Based on the process prescribed in the Informal Trading By-law, Council adopts the revised informal trading plan for Ward 1, as indicated in Annexures A – C.

2. That areas indicated on Annexures A – C be declared areas in which the carrying on of the business of street vendor, peddler or hawker is prohibited, with the exception of the informal trading bays reflected in Annexures A – C.

3. The areas indicated on Annexures A – C be declared areas that are restricted to persons in possession of a valid informal trading permit issued by the City of Cape Town for the particular trading spaces.

4. The trading bays mentioned in Annexures A – C be let out by means of a permit system and that no street vending, peddling or hawking be permitted in these informal trading bays if a person is not in possession of a valid permit for the particular trading spaces.

5. The trading hours for all approved informal trading sites be seasonally adapted from 06:00 to 19:00 from Mondays to Sundays.

6. Based on the provisions of the Businesses Act, Act 71 of 1991, council to revoke the proclamation published in the Province of the Western Cape:  Provincial Gazette Notice 7515 dated 23 October 2015 where that proclamation impacts the demarcated informal trading areas contained in this report.

7. That the Giel Basson site be removed from the proposed trading plan due to the line departments objections as well as the public objections to the site.

8. The comments (Annexure G) from the external public participation process collected during two comment periods which ran from 11 March 2020 to 14 April 2020; as well as 7 October 2020 to 7 November 2020 respectively be noted and to support the responses provided by Area Economic Development.

1. The objections contained in this report be not upheld for the reasons stated in the report with the specific exception of the Giel Basson site for the reasons as outlined in the contents of this report.
