Resolution detail

That Subcouncil 18 SUPPORTS and RECOMMENDS that Erf 109798 Cape Town, situated at Blode Street, Lavender Hill, in extent approximately 2.2935 Hectares, which is indicated in more detail by the figure ABCDEFGHJKL on  Plan LT 1668v0,as Annexure “A”, be reserved for the the Department Urban Management (Area South), subject to the following conditions:
 

1. The subject property is to be used to develop and establish a community benefit venture to be utilized for social, recreational and purposes ancilary thereto, which venture is to be outsourced to an NPO/Public Benefit Organisation.

2. The Department Urban Management (Area South),  takes responsibility for any required rezoning and/or any other land use processes which may be required, as well as compliance with any related legislation, the funding and liability for costs whereof to be regulated by a Management Agreement/MOU with an NPO/Public Benefit Organisation.

3. Sufficient funding should be made available to operate, manage and maintain the property and structures on the facility, inclusive of resources, labour, equipment, general operating expenses, including maintenance costs, utility consumption, security and content insurance, as is applicable. A Management Agreement/MOU with an NPO/Public Benefit Organisation will govern the funding and operational expenses responsibilities;

4. All costs, related to this application and in the above regard, to be provided for by the Department Urban Management (Area South) as regulated by a Management Agreement/MOU with an NPO/Public Benefit Organisation.
