ESOLVED TO RECOMMEND
Subcouncil notes and supports the recommendation that:

In terms of section 14(2)(a) and (b) of the Municipal Finance Management Act (MFMA), Act 56 of 2003:

Council resolves that Erf 84126, situated at 3 Sasmeer Road, Retreat, Cape Town in extent approximately 511m², zoned Single Residential 1 (SR1) and Transport zone 2 (TR2), shown lettered ABCDE on the attached Plan LIS 2029, not be required for the provision of the minimum level of basic municipal services;

Council confirms that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset, described in (a)(i) have been considered.

In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, Council approves in principle the transfer of Erf 84126, Cape Town as decribed in (a)(i);

Erf 84126, Cape Town be transferred by way of public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.

In terms of Section 4 of the Immovable Property By-law 2015, Council approves the closure of a portion of the public street on the subject property, Erf 84126, situated at 3 Sasmeer Road, Retreat, Cape Town, zoned Transport zone 2 (TR2).
