Subcouncil 6 supported and noted the report and recommended to the Director: Property Management that the lease of portions of City Land namely Portion of Erf 7540 , Portion of Rem Erf 7541, Portion of Erf 7545 Bellville, Portion of ERf 21602 Bellville and Erf 7543 Bellville shown hatched ABCDEFG, HJKLM and NPQRSTUVW on the attached Plan No TA 1057v1, marked annexure A to the report, in extent approxiamately 470, 584 and 340m² respectively to ACVV – Ons Tuiste Dienstak (011-740 NPO), the owner of Erven 7544; 7590 and 36095 Bellville, or their successors in title be approved subject inter alia to the following conditions that:

A tariff rental of R966,09 per annum excluding VAT, as indicated in Annexure B, calculated at the rate applicable as the time of transaction be payable. Rates not applicable;

The lease will endure for a period of ten years;

The rental will be adjusted annually in terms of the rental tariff structures as approved by Council;

The property be used for security and parking purposes only;
-
Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
-
Subject to compliance with any other statutory requirements;
-
No compensation will be payable for any improvement made to the property;
-
All outstanding accounts with the City of Cape Town must be settled;
-
No underground municipal services are affected.

Lease portion ABCDEFG be dealt with in a separate lease agreement as that portion will be affected by the future De Lange/Maree Road realignment. When the road realignment commences the lease agreement can be terminated withour affecting the other two lease areas.

Engineering plans must be submitted for the parking area proposed on Erf 7543.

The boundary wall along line G-A-B on sketch plan must be demolished and disposed of at the cost of applicant when the lease is terminated to allow the road realignment to commence.

The lease area must be reinstated to the satisfaction of the City of Cape Town when the lease is terminated. .
