Resolution detail

RESOLVED that,
 

  1. a tariff rental of R920 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
 
  1. the lease will endure for a period of ten years with the option to renew for a further ten years;
 
  1. the rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. the property be used for Educare purposes only and no other structures other than the existing fencing will be permitted within the lease perimeter;
 
  1. subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property.
 
  1. Electricity services exists within the proposed lease area and any alterations or deviations to the electricity services necessary as a consequence of the proposal, or requested by the applicant will be carried out at the applicant’s cost;
 
  1. A minimum clearance of three meters to any overhead mains conductors shall be maintained;
 
  1. Telkom services exist within the lease area and it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
 
  1. Telkom requires access to carry out maintenance or upgrade existing plants at all times;
 
  • The conditions from the Executive Director City Health attached as Annexure “B” must be adhered to;
 
  1. The premises must comply with the National Building Regulations (NBR) and By-Law relating to community Fire Safety and any other applicable legislation;
 
  • The refuse generated on the premises must be stored on the premises to the satisfaction of the Director: Solid Waste;
 
  • The area to be leased is zoned Public Place and Public Street and therefore requires a temporary land use departure in terms of section 15 (2) of the Cape Town Zoning Scheme Regulations
