RESOLVED that:
It is recommended that:
a) Council resolve in terms of Regulation 20(1)(f)(i) of the Municipal Asset Transfer Regulations that Erf 107892 shown lettered ABCDEFGHJK on the attached plan STC 2714 marked Annexure A is not required for the provision of any minimum level of basic municipal services and is surplus to the requirements of the Municipality.
b) That the transfer of Erf 107892 located at Eland Street and Abdurahman Avenue, Kewtown, and shown lettered ABCDEFGHJK on the attached sketch plan STC2714 marked Annexure A, in extent 2206 m², to the Western Cape Provincial Government, or their successor(s) in title, be approved, subject inter alia to the following conditions, that:
i) A market-related purchase price of R254 300 excluding VAT of 15%, being
R 38 145 (in total R292 445), where applicable, be payable.
ii) The valuation is to be reviewed if not implemented within 24 months from
date of valuation, i.e. by 2022-04-30;
iii) Rates and municipal charges, if applicable, be levied:
iv) That all further statutory and land use requirements be complied with by the purchaser;
v) Further conditions to be imposed by the Director: Property Management in
terms of her delegated authority.
vi) That all costs related and incidental to the transaction be borne by the
purchaser.
